Birth Injury

The birth of a child should be both a joyous and a memorable occasion. Unfortunately, many births have complications resulting in injury. An injury that a child sustains during birth may cause lifelong complications. In some cases, the action or inaction of a doctor, emergency room, or hospital may be liable for injuries to the mother and/or child. The injured person should, obviously, be compensated in such circumstances. Some of the common birth injury cases that occur involve:

  • Brain damage
  • Cerebral palsy
  • Erb's palsy
  • Breathing problems and related injuries
  • Failure to diagnose a complication condition
  • Wrongfully induced labor
