The lawyers on the opposing side of a personal injury case are generally representing an insurance company. Insurance companies are in the insurance business to make money. In order to recover on a personal injury lawsuit, the injured part (the plaintiff) must establish the following:
- Duty of Care – One must establish that there is a duty of reasonable care involved. A common example is that we each owe a duty of care to others when we drive a car. Another example is that property owners generally owe a duty to keep their premises safe.
- Breach – One must show that the person causing the injuries failed to provide the duty of care owed to the injured party.
- Causation – It must be shown that the defendant’s actions actually were the cause of the harm.
- Damages – One must show that damages have actually occurred.
It should also be noted that the injured party plaintiff bears the burden of proving the personal injury claim.
